During the 2022 Session, the Legislature passed CS/HB 105 (Fine), which authorizes cities and counties to restrict smoking within the boundaries of any public beach or park they own.
The bill specifies that municipalities can restrict smoking within the boundaries of a beach or park that is owned by the county but located within the city, as long as it does not conflict with any county ordinance. The bill prevents cities and counties from restricting unfiltered cigars.
After the Governor signed the bill, the new law became effective on July 1, 2022. Several municipalities have already adopted ordinances implementing new smoking regulations, examples of which can be found below. If your city adopts a similar ordinance, please share by emailing a copy of your ordinance to ttaggart@flcities.com.
