HB 359 (Duggan) would allow for the Capital Improvement Element of Local Comprehensive Plans to have the option to modified administratively if all the projects have been adopted by the project’s appropriate board. Additionally, the bill amends language to allow for the prevailing party in a challenge to recover attorney fees and costs in challenging or defending a plan or plan amendment, including reasonable appellate attorney fees and costs.
